2. The petitioner was applicant for her selection to the post of Sub-Inspector of Police against Advertisement No. 01 of 2017. According to her, she cleared Preliminary Test, Written Examination (Main) as well as Physical Efficiency Test but she has not been finally selected.

3. This writ application has been filed in that background, seeking direction to the Bihar Police Subordinate

Patna High Court CWJC No.23659 of 2019(2) dt.29-11-2019 2/3 Service Commission to recommend her name for her appointment against a post of Sub-Inspector of Police. It has been asserted that 52 vacancies, which were advertised, have yet not been filled up.

4. There is no averment, however, in the writ application that any candidate lower in merit has been selected, ignoring the petitioner's claim. It is her case, on the other hand, that though she has been seeking information under the Right to Information Act from the respondents, in respect of the said process of selection, no information is being supplied.

5. Learned counsel appearing on behalf of the Commission, on the other hand, has submitted that fresh advertisement has been issued and the vacancies have been advertised. Any panel prepared on the basis of Advertisement No. 01 of 2017 in question, has, thus, completely lost its significance. He has further submitted that the vacancies, which remained unfilled because of non-availability of the desired number of scheduled caste candidates have been taken into account in the subsequent advertisement for the post of Sub Inspector of Police.

6. Considering the fact that the petitioner has not been able to make out any case of violation of his fundamental

This application is, accordingly, dismissed.
