JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-11-2019 Heard counsel for the petitioner and counsel appearing on behalf of the State as well as the complainant. The petitioner is apprehending arrest in connection with Complaint Case No. C-1994 of 2018, Trial No. 402 of 2018 for offences under Sections 406 and 420 of the Indian Penal Code.

It is alleged that eight blank cheques were handed over to the petitioner by the complainant and out of those eight blank cheques the petitioner used one blank cheque for misappropriation of the money.

Counsel for the petitioner submits that against the informant on account of money transaction earlier a case was

Patna High Court CR. MISC. No.76616 of 2019(2) dt.27-11-2019 2/2 filed on behalf of the petitioner which was compromised. Counsel refers to Chakiya P.S. Case No. 333 of 2017. Learned counsel appearing on behalf of the complainant is not in a position to furnish details of the blank cheques purportedly handed over to the petitioner. Under the aforesaid circumstances, the court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in connection with Complaint Case No. C-1994 of 2018, Trial No. 402 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P. C.
