JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Dighwara P.S. Case No. 178 of 2019 registered for the offences punishable under Sections 341, 323, 498A, 504/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

As per FIR petitioner happens to be husband of daughter of informant and allegation is that he subjected her to cruelty with respect to demand of Rs.2 lac and it further appears that several times he assaulted her and she received severe injuries on her eye.

Submission of learned counsel for the petitioner is that he is ready to keep her with dignity and care and whole

On the other hand, learned counsel for the informant has submitted that due to assault vision of daughter of informant was seriously affected, as such it is not possible for her to reside with the petitioner. Heard learned APP also.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
