The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 441, 323, 324, 307, 379/34 of the Indian Penal Code. Prosecution case as per written report is that on 03.09.2019 at about 09 O' Clock when the father of informant and his daughter went to Katihar Court and informant was alone in his house in the meantime both the accused petitioners came with motorcycle along with two unknown persons and entered in his house and pushed cloth in his mouth and assaulted him and inflicted knife blow on his forehead with intention to kill him thereafter they fled away with Rs. 18,000/- with threatening to kill him.

Patna High Court CR. MISC. No.73230 of 2019(3) dt.05-03-2020 2/2 Learned counsel for the petitioners submits that petitioners are innocent, committed no offence and have been falsely implicated in this case. He submits that petitioners and informant are relative to each other. He further submits that petitioners bear no criminal antecedent.

By order dated 03.02.2020, case diary was called for and the injury report in para-33 of the case diary shows that there is superficial cut injury on the neck and the injury is found to be simple in nature.

In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Katihar in connection with Katihar (M) Police Station Case No. 229 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
