2. The petitioner is apprehending arrest in connection with Shahpur P.S. Case No. 170/2024 registered on 10.05.2024 for the offenses punishable under Section 306 of the Indian Penal Code.

3. As per the prosecution, the F.I.R. has been lodged against the petitioner. It is alleged in the F.I.R. that the petitioner had been blackmailing and harassing the daughter of the informant over a prolonged period by using pornographic photographs of her, which he had procured at gunpoint. It is further alleged that, due to such acts, the victim had earlier

The petitioner is also alleged to have circulated the said photographs among the victim's family members, leading the victim into a state of depression, ultimately resulting in her committing suicide by hanging herself from a ceiling fan.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. It is further submitted that the petitioner has no criminal antecedents. Counsel also contends that the victim was leading a happy marital life with her husband and children, and it is surprising that the present F.I.R. has been lodged by the victim's father and not by her husband. The non-filing of a criminal complaint by the victim's husband casts serious doubt on the prosecution's version. It is argued that the petitioner has been falsely and unnecessarily implicated in the present case.

5. Learned counsel for the informant vehemently opposes the prayer for bail and submits that the petitioner was previously involved in a similar criminal case lodged by the victim. At the time of furnishing bail in that case, the petitioner had given an undertaking that he would not repeat such conduct. However, despite the undertaking, he allegedly resumed his acts of harassment, which pushed the victim into depression and

Patna High Court CR. MISC. No.85926 of 2024(3) dt.13-05-2025 3/3 ultimately led her to take her own life. It is further submitted that the petitioner is directly responsible for abetting the suicide of the victim by repeatedly blackmailing her and circulating her objectionable photographs.

6. Learned APP for the State also opposes the prayer for bail and submits that the petitioner's acts were the direct cause of the victim's suicide.

7. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Shahpur P.S. Case No. 170/2024, pending before the learned Judicial Magistrate, 1st Class, Danapur is hereby rejected.
