JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 31-10-2018 Heard learned counsel for the petitioner and the opposite parties Petitioner has filed this contempt application alleging violation of the order dated 24.04.2018.

This Court considering the communication of the District Magistrate, Aurangabad dated 04.06.2014 recommending regularization of the petitioners on different Group D posts has disposed off the writ petition directing the District Magistrate to complete the formalities pursuant to his recommendation dated 04.06.2014.

Show cause has been filed in the instant proceedings. It has been stated with reference to one communication dated 20.07.2018 from the office of the Chief Engineer, Water Resources Department that the petitioner's recommendation was

Patna High Court MJC No.3465 of 2018 dt.31-10-2018 2/2 made without approval of the Chief Engineer of the Department and without its roster clearance. Accordingly, the respondents have not found the petitioner's claim worthy of consideration for regularization. The communication dated 20.07.2018 is disputed by the petitioner. He submits that prior to the names being sent to the District Magistrate, Aurangabad roster clearance had been done. He disputes the reasons assigned in the communication dated 20.07.2018 bearing no. 616 issued under the signature of the Chief Engineer Opposite Party no. 4. In view of the reasons assigned in the communication dated 20.07.2018 it is apparent that the opposite parties have found the petitioner's claim unworthy of consideration for regularization.

No further order needs to be passed in the instant contempt proceedings. However, the petitioner would be at liberty to assail the reasons contained in letter dated 20.07.2018 in the appropriate proceedings.

Contempt application is dismissed.
