JUSTICE SANJAY PRIYA ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Kutumba P.S. Case No. 182/2017, instituted for the offences under Sections 170, 171 and 212 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of Arms Act and Section 17 of CLA Act.

Learned counsel for the petitioner has submitted that there is no recovery of any incriminating article from possession of this petitioner. Name of this petitioner has come in confessional statement of co-accused Manish Kumar, who was arrested by the police. It is further submitted that other accused persons with similar allegation have already been granted bail by different Benches of this Court in Cr. Misc. Nos. 57398/2018

Patna High Court Cr.Misc. No.57593 of 2018 (2) dt.09-10-2018 2/2 dated 20.09.2018 and 58837/2018 dated 06.10.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 182/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
