====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-03-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sessions Trial No.379 of 2016, arising out of Ekma P.S. Case No.12 of 2015, registered under Sections 302 and 201 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that the informant being the Chowkidar of Ekma Police Station, District-Saran, on receiving the information about lying the dead body in the wheat field of Upendra Pandey at village-Rith went there and saw the gathering of the people there and unknown dead body was found at the wheat field. On query, the villagers disclosed that this petitioner along with three unknown were seen near the

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that none had seen the occurrence. On mere suspicion, the petitioner has falsely been implicated in this case and he is in custody since 10.02.2016. Further submission is that while the charge has been framed against the petitioner in this case on 11.07.2016 but uptil now, only two prosecution witnesses have been examined. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VIII, Saran at Chapra, in connection with Sessions Trial No.379 of 2016, arising out of Ekma P.S. Case No.12 of 2015. Out of the two sureties, one must be either parents or the close relative of the petitioner.
