JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2020 Heard learned counsel appearing for the petitioner no.1, namely, Dharmendra Kumar @ Dharmendra Yadav as well as learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner no.1 apprehends his arrest in connection with Gandhi Maidan P. S. Case No.116 of 2019 registered for the offences punishable under Sections 420, 379/ 34 of the I.P.C. and Section 66(C) of the Information Technology Act, 2000. The name of petitioner no.1 came in this case in confessional statement of Ranjeet Kumar and Ajay Kumar and except the aforesaid statements, there appears to be nothing against the petitioner.

Patna High Court CR. MISC. No.78753 of 2019(6) dt.14-07-2020 2/2 The Senior Superintendent of Police, Patna vide his letter no.477 dated 11.02.2020, has reported that petitioner no.1 was made accused in Manjhauli (West Champaran) P. S. Case No.228 of 2019, it is obvious that the aforesaid Manjhauli (West Champaran) P. S. Case No.228 of 2019 was registered after institution of the present case.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner no.1, namely, Dharmendra Kumar @ Dharmendra Yadav, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-XVII-cum-Additional Chief Judicial Magistrate, Patna in connection with Gandhi Maidan P. S. Case No.116 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
