The petitioner is in custody in connection with Sitamarhi P.S. Case No. 387 of 2019 registered for the offences under Section 376 IPC and 4 of the POCSO Act. Considering nature of allegation, the Court is not inclined to grant bail to the petitioner. The prayer is rejected. However, the court below is directed to expedite the trial and conclude the same within a period of nine months. In the event the trial is not concluded within the aforesaid period of nine months and if there is no any laches on the part of the petitioner in conclusion of the trial, the petitioner may renew his prayer for bail after nine months.
