2. The prayer for bail of the petitioner has earlier been rejected vide order dated 16.05.2025 passed in Criminal Miscellaneous No. 8523 of 2025 and vide order dated 20.02.2024 passed in Criminal Miscellaneous No. 9501 of 2024.

3. Learned counsel for the petitioner submits that the petitioner is in custody since 03.08.2023 having no criminal antecedent.

4. Learned APP for the State opposes the prayer for bail.

5. Learned counsel for the Union of India opposes the

Patna High Court CR. MISC. No.79802 of 2025(2) dt.19-12-2025 2/2 prayer for bail and submits that total 1 kg charas, i.e. commercial quantity has been recovered from the possession of the petitioner.

6. Considering the nature of recovery, I am not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Raxaul P.S. Case No. 366 of 2023, pending before the learned Exclusive Special Court-1, N.D.P.S., East Champaran, Motihari is hereby rejected.
