2. The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 342, 323, 324, 325, 307, 302, 504 of the Indian Penal Code.
3. As per F.I.R., all the named accused persons, including this petitioner, variously armed, surrounded informant and his family members. It is further alleged that co-accused Rambabu Rai and Lalbabu Rai assaulted son of informant with sword, on account of which, son of informant died.
4. Learned counsel for the petitioner submits that both parties are agnates and there is land dispute between them. As per F.I.R. itself, specific accusation of assault is against coaccused Rambabu Rai and Lalbabu Rai. So far as this petitioner is concerned, there is general & omnibus allegation and no
Patna High Court CR. MISC. No.79253 of 2025(2) dt.09-02-2026 2/2 specific overt act has alleged against him. Similarly situated coaccused persons have been granted anticipatory bail, vide orders annexed as Annexure P/2 & P/3 respectively to this bail application. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Trial Court within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, (west), Muzaffarpur in connection with Paroo P.S. Case No. 327 of 2023, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
