The petitioner seeks regular bail in connection with Sahiyara P.S.Case No. 97 of 2017, registered for the offence under Sections 304 (B0/34 of the Indian Penal Code. Allegation against the petitioner as per F.I.R. is of setting the deceased on fire, who happens to be the wife of the petitioner.

Submission of the learned counsel for the petitioner is that the petitioner has not committed any offence and he has falsely been implicated in this case and she attempted to commit suicide as the petitioner was not ready to keep her with him at Punjab and the petitioner has no criminal antecedent and

Patna High Court Cr.Misc. No.60405 of 2018 (3) dt.01-11-2018 2/2 moreover, he is in custody since 02.04.2018.

Heard learned A.P.P. also who opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage. However, the petitioner is at liberty to renew his prayer for bail once informant is examined during trial. With the aforesaid observation, the instant petition is accordingly dismissed.
