The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 148, 149, 188, 341, 323, 332, 143, 333, 353 and 302 of the Indian Penal Code.
As per FIR, accused persons are beating one person alleging him to be child thief in village-Mahamadpur and due to which he died.
Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner. He submits that the petitioner has falsely been implicated in this case due to local village politics. He submits that similarly situated co-accused have been granted bail by
Patna High Court CR. MISC. No.77892 of 2019(2) dt.02-12-2019 2/2 coordinate Bench of this Court in Cr. Misc. No. 71059 of 2019 on 07.11.2019 and Cr. Misc. No. 64196 of 2019 on 22.10.2019. He further submits that petitioner bears no criminal antecedent. In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Danapur at Patna in connection with Naubatpur Police Station Case No. 526 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
