JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-06-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of Union of India. Learned counsel appearing on behalf of the petitioner submits that the petitioner applied for voluntary retirement with effect from 1.11.2002 which was granted vide order dated 18.8.2001.

A counter affidavit has been filed on behalf of respondents no.1 to 5. From perusal para 1 to 5 of the counter

Patna High Court CWJC No.25005 of 2019(3) dt.22-06-2020 2/2 affidavit, it appears that the respondents have decided to revise pension of the petitioner to Rs. 19,950/- as per seventh pay revision but approval is still awaited.

Considering the aforesaid, the writ petition is disposed of with a direction to the respondents to take final decision with regard to grant of all monetary benefits to the petitioner in revised pension, if not already taken, within a period of three months from the date of receipt/production of a copy of this order with all consequential monetary benefits, failing which the petitioner would be entitled to payment of interest at the rate of 9% from the date of filing of the writ application dated 12.12.2019 till the date of actual payment.

With the aforesaid, the writ application stands disposed of.
