At the very outset, learned counsel for the petitioners seeks permission to withdraw the prayer for anticipatory bail of the petitioner no. 2.

Permission is granted.

Accordingly, the prayer for anticipatory bail made through the instant application, on behalf of the petitioner no. 2 is dismissed as withdrawn.

Now, the present application is being heard for consideration of bail of the petitioner no. 1. 6.
The petitioner no.1 apprehend his arrest in a case
Patna High Court CR. MISC. No.86368 of 2024(2) dt.17-12-2024 2/2 registered for the offence punishable u/s 341, 323, 307, 504, 506 and 34 of the IPC.

The allegation is that petitioner no.1 is of order giver and petitioner no. 2 has assaulted on the head of Reena Devi. 8.
It is submitted by learned counsel for the petitioners that petitioner no.1 is quite innocent and has committed no offence. He have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. Petitioner no.1 has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 10.
Having regard to the facts and circumstances of the case, since there is no specific overt act against the petitioner no. 1, let the above named petitioner no. 1, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Mashrakh P.S. Case No.208 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Suruchi/- U T
