2. The petitioner apprehends arrest in a case registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

3. As per prosecution case, it is alleged that petitioner under conspiracy, got appointed as Panchayat Teacher on the basis of forged and fabricated documents.

4. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. As a matter of fact, the report submitted by the B.S.E.B. through letter dated 21.05.2024 is incorrect and the reevaluated marksheet was not attached with the report given to the Vigilance. Due to the mistake of B.S.E.B. in furnishing the correct report, the present case has been registered against the

Patna High Court CR. MISC. No.84633 of 2024(3) dt.28-01-2025 2/2 petitioner. Moreover, petitioner has already been terminated from the post of Panchayat Teacher. Petitioner has got clean antecedent.

5. Learned counsels appearing on behalf of the Opposite Parties vehemently opposed the prayer for bail by contending that petitioner got herself appointed as Niyojit Panchayat teacher by tampering her marks obtained and her division in the Intermediate marks sheet and Provisional certificate issued in her name.

6. Having considered the fact that petitioner has already terminated from the post of Panchayat Teacher, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkauliya P.S. Case No. 387 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
