2. Petitioner apprehends their arrest in a case registered for the offence punishable under sections 126(2), 115 (2), 117 (2), 303 ( 2 ), 352 (3) (5) of Bhartiya Nyay Sanhita ( B N S ), 2023 .
3 . The prosecution case in brief, is that on the alleged date and time of occurrence , petitioner assaulted on the head of informant with lathi due to which he sustained injury . It is further alleged that the accused persons snatched Rs. 49,000/- from the pocket of informant.
4. It is submitted on behalf of the petitioner that both the parties are co-villager and this petitioner has falsely been implicated in this case due to enmity . Allegation of assault is
Patna High Court CR. MISC. No.83743 of 2024(3) dt.27-01-2025 2/2 general and omnibus. Injury allegedly caused by this petitioner is simple in nature . Petitioner claims clean antecedent. 5 . Learned counsel for the informant opposed the bail petition .
6 Considering the nature of injury , clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Xth Gaya in connection with Fatehpur P.S. Case No. 407 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
