2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 420, 423, 466, 467, 468, 469 and 471 of the Indian Penal Code.

3. As per the prosecution case, petitioners got the forged sale deed executed by impersonating another person as the informant.

4. It is submitted on behalf of the petitioners that the informant has lodged this false case because of the greed and lust as after sale of the land, price of the land escalated. Petitioner no.1 is bona fide purchaser of the said land and petitioner no.2 is witness to the sale deed. Besides this, dispute is purely of civil nature for which informant has already filed Title Suit No. 269 of 2018. Petitioners claim clean antecedent.

5. Learned counsel for the State and informant oppose

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Bhabua Police Station Case No. 311 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
