JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bodh Gaya P.S. Case No. 174 of 2008 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Annexure-1 to the petition goes to show that earlier the prayer for anticipatory bail of the petitioner was rejected by this Court vide order dated 28.10.2010 passed in Cr. Misc. No. 20521 of 2010 and analogous cases directing the petitioner to surrender before the Chief Judicial Magistrate, Gaya within thirty days and seek regular bail but admittedly, the petitioner did not comply the aforesaid direction of this Court and again knocked the

Patna High Court Cr.Misc. No.60439 of 2018 (2) dt.03-10-2018 2/2 door of the Court for grant of anticipatory bail. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that there is allegation of participation of the petitioner in the alleged crime, I am not inclined to grant privilege of anticipatory bail to the petitioner and, accordingly, his prayer for anticipatory bail in connection with Bodh Gaya P.S. Case No. 174 of 2008 stands rejected.
