ANJANA MISHRA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.07.2019 in connection with Piri Bazar P.S. Case No.83 of 2019 registered for the offence under Sections 147, 148, 149, 307, 353 of the Indian Penal Code, Section 27 of the Arms Act and Section 16/17/18/20/23/28 of the U.A.P. Act.

Learned counsel for the petitioner submits that though the name of the petitioner figures among the 60 accused persons in the F.I.R, there is no specific allegation attributed to the present petitioner. Learned counsel for the petitioner submits that only on the basis of some secret information, the F.I.R. was lodged that certain persons were trying to give effect and conduct naxali operation in the area

Patna High Court CR. MISC. No.76850 of 2019(2) dt.04-12-2019 2/2 and on the said basis, the police force conducted a raid and arrested the present petitioner along with others. It is further submitted that there has been no recovery from the present petitioner and other similarly situated co-accused persons have since been extended the privilege of bail by Co-ordinate Benches of this Court in Cr.Misc. No.60549 of 2019 vide order dated 20.11.2019 and also in Cr.Misc. No.64624 of 2019 vide order dated 16.10.2019. Learned counsel for the petitioner submits that the petitioner is merely a field worker and has nothing to do with any criminal activity, more so naxali activities.

Having considered the entire facts and circumstances and the nature of allegations made and also because the petitioner has clean antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Piri Bazar P.S. Case No.83 of 2019.
