Additional Advocate General 3 ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-01-2025 Heard learned counsel appearing on behalf of the petitioner and the learned AAG 3 for the State.

Learned counsel appearing on behalf of the petitioner seeks review of judgment dated 25.09.2023 passed in CWJC No.6782 of 2023 on the ground that, vide order dated 25.09.2023, appropriate directions were issued, however, due to inadvertence, impugned order dated 08.07.2020 contained in Memo No.4803 could not be set aside, as such, the order is not being complied with.

3. In paragraph no.3 of judgment dated 25.09.2023 passed in CWJC No.6782 of 2023, following order was passed, which inter alia is re-produced hereinafter : -

Considering the aforesaid submission made on behalf of the petitioner, without going into the merits of the case, petitioner may file his detailed representation along with a copy of the judgment dated 26.06.2023 passed in LPA No.198 of 2016 (The Registrar General, Patna High Court vs. Ram Vyas Dubey and Ors.)."

4. Considering the aforesaid submissions made on behalf of the petitioner, as well as, the statement made in the present Civil Review application and in paragraph no.3 of judgment dated 25.09.2023 passed in CWJC No.6782 of 2023, it has been directed to the petitioner to file a detail representation, however, at the same time, in the light of judgment date 26.06.2023 passed in LPA No.198 of 2016, the impugned order dated 08.07.2020 contained in Memo No.4803 was required to be set aside, which has caused inconvenience to the petitioner in view of the apparent mistake in Paragraph no.3 of order dated 25.09.2023 passed in CWJC No.6782 of 2023, and the same shall now be read as follows : - "Considering the aforesaid submissions made on behalf of the petitioner, without going into the merits of the case, the order order dated 08.07.

2020 contained in Memo No.4803 is hereby set aside and quashed. The petitioner may file his detail representation along with a copy of the judgment dated 26.06.2023 passed in LPA No.198 of 2016 (The Registrar General, Patna High Court vs. Ram Vyas Dubey & Ors.)

5. The judgment dated 25.09.2023 passed in CWJC

Patna High Court C. REV. No.347 of 2024(2) dt.24-01-2025 3/3 No.6782 of 2023 is modified to the above extent and the other parts of the judgement shall remain intact.

6. Accordingly, the present Civil Review application stands disposed of.
