Counsel for the petitioner fairly submits that during pendency of the writ petition, all such pension and pensionary benefits except Earned Leave, has already been settled and paid, and it has further been stated that earned leave has been adjusted against unauthorized leave, for which this petitioner is entitled to salary, which has not been paid, and as also the benefits under the A.C.P has also not been extended, which is detailed in Para 8 of the rejoinder filed on behalf of the petitioner to the counter affidavit of Respondent Nos. 4 & 5.

On the other hand, counsel for the State submits that for these two reliefs, the petitioner may be directed to file an appropriate representation by fixing a timeline, so that, the grievances of this petitioner can be redressed by passing reasoned and speaking order and upon finding the petitioner's entitlement to be justified in law, the same shall also be extended to him, within the time specified by this court.

Considering the submission of the respective parties, this Court is of the view that instead keeping this matter pending, the petitioner is directed to file a detailed representation seeking redressal of his grievances in respect of Earned Leave, which is said to have been adjusted against unauthorized leave for which this petitioner is entitled for salary, and as also for the benefits under Assured Career Progression Scheme, the details of which has already been made in the rejoinder filed on his behalf. It is expected that all such exercises shall be carried out within a period of four weeks from today with all supported materials, along with copy of the orders of this Court, shall be submitted and on such submission, Respondent No. 2 - Director, Panchayati Raj Department, Government of Bihar, Patna shall pass reasoned and speaking order with regard to the claim of this petitioner, and on

Patna High Court CWJC No.18151 of 2024(3) dt.12-12-2025 3/3 adjudication, if it is found the petitioner is entitled to the benefits, for which the representations have been made, the benefits shall be extended to him within the same time.

5. Accordingly, the instant writ petition stands disposed of.
