The petitioner seeks pre-arrest bail in connection with Ara Nawada P.S. Case No.617 of 2017 registered under Sections 420 and 468/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that initially a complaint was filed which was referred to the police under Section 156(3) of the Code of Criminal Procedure for investigation pursuant to which the FIR was instituted. The allegations made in the FIR do not attract any ingredients of the offences punishable under Sections 420 and 468 of the Indian Penal Code as the petitioner had executed sale deed with respect to his own share of land.

Considering the nature of allegation and the plea

Patna High Court Cr.Misc. No.67613 of 2018(3) dt.18-12-2018 2/2 taken by the petitioner, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S. Case No.617 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
