2. The petitioner seeks regular bail in connection with Dhanarua P.S. Case No. 94 of 2023 for the offences registered under Sections 304(B), 323, 504, 341 and 201/34 of the Indian Penal Code.

3. As per the prosecution case, allegation against the petitioner and his family members is that they committed murder of the victim due to non-fulfillment of demand of dowry.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Allegation against the petitioner is general and omnibus. Informant and his family members were also present at the time of funeral of the deceased but due to ulterior motive, the present

It is further submitted that the petitioner along with his wife was going to his Sasural by e-rickshaw but due to road breaker his wife got injury on her head. When she was taken to the hospital she succumbed to injuries. Due to miscommunication, informant filed the present case. When the informant came to know the real fact a compromise petition has been filed before the court concerned with the above said fact. Petitioner has no criminal antecedent. He is in custody since 28.08.2023.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Dhanarua P.S.
