JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 03-10-2018 Heard learned counsel for the petitioner and the learned counsel representing the State.

Petitioner in the present case is seeking quashing of the order dated 14.07.2018 passed by the Sub-Divisional Officer, Arwal, by which it is alleged by the petitioner that the SubDivisional Officer has decided title in favour of the respondent no. 6.

This Court has gone into the order as contained in Letter No. 493 dated 14.07.2018, a perusal of which shows that there is certain dispute with regard to the land in question between the parties and in Paragraph No. 4, the Sub-Divisional Officer has categorically held that in absence of measurement with the consent

Patna High Court Cr. WJC No.2405 of 2018 (2) dt.03-10-2018 2/2 of the parties it appears to be a case of land dispute which is desired to be adjudicated by a competent Civil Court. In the opinion of this Court, the Sub-Divisional Officer has not decided the question of title in the present case, however, in order to deal with the law and order situation, certain directions have been issued in case of dispute between the parties which may have a potential to disturb the law and order situation in the present case.

This Court would not interfere with the impugned order. The petitioner may seek his remedy in accordance with law in a competent Court.
