The matter has been taken up through video conferencing.

The petitioner seeks bail in Khutauna P.S. case No. 11/2019 registered under Section 341, 344, 307, 379, 506 of the Indian Penal Code.

The wife of the petitioner alleged that while she was cooking rice her husband suddenly came and began to abuse her. Her husband poured hot rice water on her body. She got burn injuries on her entire body.

The learned counsel for the petitioner submits that the petitioner is in custody since 02.04.2019. His wife is still alive and she is living with her child. From perusal of the injury report it would appear that opinion regarding injury was kept reserved. Wife of the petitioner was referred to Sadar Hospital. It is further submitted that wife of the petitioner got burn injuries while cooking rice but since petitioner had quarreled

The learned APP, however, opposed the prayer for bail. Perused the FIR and the case diary.

There is allegation that petitioner poured hot rice water on the body of his wife causing injuries on thigh and other parts of her body. From the injury report it appears that opinion with regard to injury was kept reserved. The petitioner is in custody since 02.04.2019 and the petitioner has remained in custody for one year and two months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Jhanjharpur, Madhubani in connection with Khutauna P.S. case No. 11/ 2019.
