The Petitioner seeks regular bail in connection with Piro P.S.Case No. 236 of 2018, registered for offences punishable under Sections 25 (1-B) a/26 of the Arms Act. As per F.I.R. allegation against the petitioner is of recovery of one country made pistol with live cartridges from the possession of the petitioner and accordingly, seizure list has been prepared.
Submission of the learned counsel for the petitioner is that no incriminating article has been recovered from the possession of the petitioner rather there is joint family house and the petitioner has no knowledge about the said arms and the
Patna High Court Cr.Misc. No.57970 of 2018 (2) dt.28-09-2018 2/2 petitioner is in custody since 19.07.2018 .
Heard learned A.P.P. also, who opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, at this stage, I am not inclined to grant bail to the petitioner, however once charge has been framed and trial commence, he will be released to the satisfaction of the trail court on condition that he will co-operate in disposal of trial. This application is accordingly disposed of.
