The petitioner seeks pre-arrest bail in connection with Kudra P.S. Case No. 286 of 2019 registered under Section 302/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that except wild suspicion and hypothetical presumption, there is no material against the petitioner to connect him with the alleged offence.

Learned counsel for the State and the learned counsel for the informant submitted that it is true that there is no direct evidence against the petitioner, but there are sufficient circumstantial materials to show culpability of the petitioner. Regard being had to the facts and circumstances of

No.75095 of 2019(6) dt.06-03-2020 2/2 the case and the submissions advanced at the Bar, in the event of arrest or surrender before the court below, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Kaimur at Bhabua in connection with Kudra P.S. Case No. 286 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
