2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103 (1), 3(5) of the BNS and Section 27 of the Arms Act.

3. The case of the prosecution is that the informant found a dead body but after all efforts it could not be identified and near the body broken bangles, blood stained soil and four empty shells were recovered. Thereafter, FSL team was informed. Hence, the present FIR.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case. Further submission is that during the course of investigation, one Akash Kumar, son of the petitioner has given

No.86449 of 2024(4) dt.21-03-2025 2/2 his confessional statement and in his confessional statement he has said that the petitioner had paid Rs. 50,000/- to the criminal for committing murder of the deceased. Further submission is that except the confessional statement of Akash Kumar, son of the petitioner, there is no material in the case diary to implicate him. Moreover, the petitioner is languishing in judicial custody since 19.07.2024 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barharia P.S. Case No. 322 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Siwan.
