The petitioner seeks bail in a case registered under Sections 414/34 of the Indian Penal Code.

Allegation is that the petitioner was apprehended with stolen motorcycle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.9.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The stolen motorcycle is alleged to have been recovered. The petitioner had no knowledge that the motorcycle in question is stolen property. He has been made accused due to mistake of fact.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Thawe P.S. case No.158 of 2019.
