2. The petitioner is apprehending arrest in connection with Kanti P.S. Case No. 394 of 2024 registered on 30.07.2024 for the offenses punishable under Sections 103, 61(2), 238, 3(5) of the B.N.S., 2023.
3. According to the prosecution, the present F.I.R. has been lodged against seven named accused persons, including the present petitioner. It is alleged that all the accused committed the murder of the informant's brother with the intention of illegally grabbing his land.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He

No.83857 of 2024(3) dt.12-05-2025 2/3 further contends that the petitioner and the informant are agnates, and that the petitioner's name has been maliciously included in the case at the instance of the informant's brother. It is further submitted that there is no eyewitness to the incident, and the petitioner has been implicated solely on the basis of suspicion. The petitioner has a clean antecedent.

Learned APP for the State vehemently opposes the prayer for bail and submits that, on an earlier occasion, the case diary was called for, and it contains both the inquest report and the post-mortem report. Upon perusal of these documents, it is evident that there are external injuries on the body of the deceased.
6. In view of the above facts and circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Kanti P.S. Case No. 394 of 2024, pending before the learned A.C.J.M., III, West Muzaffarpur, is hereby rejected.
7. However, it is directed that the petitioner shall surrender before the Trial Court within a period of six weeks from today. In the event of such surrender, the Trial Court shall pass an appropriate order on the petitioner's surrender-cum-bail
Patna High Court CR. MISC. No.83857 of 2024(3) dt.12-05-2025 3/3 application on the same day, after considering the case diary, injury report, and inquest report, without being prejudiced by the rejection of the present anticipatory bail application by this Court.
