No work is gratuitous. Beggari in any form is prohibited under Article 23 of the Constitution of India. If the petitioners are regularly working, there is no reason to deny salary to them.
Patna High Court CWJC No.1042 of 2020(2) dt.17-02-2020 2/2 The writ petition is disposed of with direction to the District Programme Officer (Establishment) , Bhojpur at Ara to verify the record and decide the claim of the petitioners for payment of salary at the earliest preferably within a maximum period of 60 days from the date of receipt/production of a copy of this order.
In the event the petitioners' appointment is valid and they have worked, the petitioners must be paid salary for the period they have worked.
With the aforesaid, the writ petition stands disposed of.
