The petitioner seeks bail in Doriganj P.S. Case No. 112 of 2018 instituted for the offence under Sections 341, 323, 504, 506 and 302/34 of the Indian Penal Code. In the written report there is specific allegation against the petitioner of assaulting grand-father of the informant with lathi, danda and putting him down on the ground, on account of which, he became unconscious and subsequently died in the hospital during treatment. Case diary has been received.
Post mortem report is available in the case diary wherein the Doctor has found injury on the person of the deceased and fracture on right side of ribs. The Doctor has
Patna High Court Cr.Misc. No.58301 of 2018(3) dt.26-11-2018 2/2 opined the cause of death due to haemorrhage and shock caused by hard and blunt substance. It is mentioned in the post mortem report that deceased was 75 years old. Therefore, this Court is not inclined to grant bail to the petitioner at this stage.
Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial and conclude the same as early as possible preferably within a period of nine months from the date of receipt of copy of this order.
