2. The petitioners apprehend their arrest in a case registered for offences under Sections 304B/34/201 of the Indian Penal Code.
3. As per the prosecution case, due to non-fulfillment of demand of dowry, the deceased has been killed by the accused persons.
4. Learned counsel for the petitioners that petitioners are quite innocent and they have falsely been implicated in the present case. The petitioner no. 01 is elder brother of the
Patna High Court CR. MISC. No.84302 of 2024(2) dt.18-01-2025 2/2 husband of deceased, petitioner no. 02 is wife of Bharat Chauhan/petitioner no. 01, and the petitioner no 03 is elder sister of husband of deceased. There is general and omnibus allegation against the petitioners.
5. Learned APP for the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case, this application for anticipatory bail is allowed.
7. Accordingly, let the petitioners, above-named, in the event of their arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Nalanda at Biharsharif/concerned court below in connection with Sarmera P.S. Case No. 281 of 2022 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
