1. To remove Suresh Kumar from merit list of P.D.S. because Suresh Kumar has got license, vide License No. 03/2018, Chalan No. 2 by conceal/hiding the fact that his wife is working as Govt. Teacher in

2/4 Rashtriya Prahmik Vidyalaya, Gamhariya, which is complete violation of food and consumer protection act of Govt. of India as well as Govt. of Bihar which contain in Annexure-I, to this Writ petition.

II. To take appropriate step against the cancellation of license of the Suresh Kumar vide License No.

03/2016, Chalan No. 2 which was issued by the authority concern on mischievous/malafidy grounds/basis.

2. The brief facts, as culled out from the writ petition, are that the petitioner is an educated, unemployed person who has passed the Intermediate Examination. He submitted his application along with the relevant documents for allotment of a P.D.S. shop. However, without considering his application, the respondent authorities allotted the P.D.S. dealership to respondent no. 7, namely, Suresh Kumar.

Aggrieved thereby, the petitioner has filed the present Writ petition seeking appropriate relief against the allotment made in favour of

3/4 respondent no. 7.

During the course of arguments, the Learned counsel for the petitioner submitted that the petitioner had submitted a representation before the Sub-Divisional Officer, Sikrahana, Dhaka, East Champaran, on 08.09.2018, and another representation before the District Magistrate, East Champaran, on 18.09.2018. However, no order has been passed on the said representations and the same are still pending. Therefore, he prayed for a direction to the respondent authorities to dispose of the represenations.

Without going into the merits of the case, and taking into consideration that the representations of the petitioner are pending before respondent nos. 4 and 5, the respondent authorities are directed to pass appropriate order on the representations of the petitioner, if still pending, and dispose same, within three months from the date of receipt of a copy of this order.

5. With the aforesaid observation, the Writ
