The grievance of the petitioner is that 10 per cent of his pension as well as full gratuity has been withheld by the State authorities.

Learned Counsel for the State submits that the petitioner retired in the year 2003 and on the date of his retirement, a criminal case as well as a departmental proceeding was pending against him, however, the departmental proceeding was subsequently quashed by this Court. She further submits

Patna High Court CWJC No.22430 of 2019(6) dt.27-02-2023 2/2 that in view of provision under Sections 43 (c) and 43 (d) of the Bihar Pension Rules, 10 per cent of pension as well as full gratuity has been withheld.

In view of the aforesaid submission, I do not find any infirmity in the action of the respondents.

This application is, accordingly, dismissed.
