2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 303(2), 74, 109(1), 352, 351(3), 3(5)of the Bharatiya Nyaya Sanhita.

3. Learned counsel for the petitioners submits that the petitioners no. 1 and 3 have antecedent of one case and petitioner no. 2 is a person of clean antecedent and petitioner no. 2 and 3 are women and the informant alleges that Guddu assaulted her by an iron rod causing injury on head, while

Patna High Court CR. MISC. No.80337 of 2025(2) dt.09-12-2025 2/3 Subash assaulted her by bhala causing injury on head and Rekha snatched her gold chain. Further, Subash and Bali assaulted her husband all over his body, next alleges that accused were accusing her of encroaching the land.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute related to land the alleged occurrence took place. It is next submitted that since the side of the informant encroached the land as such an altercation took place in which both sides assaulted each other. It is also submitted that the injury suffered by the injured has been opined to be simple in nature and petitioners are not criminals.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like
