2. The petitioner is languishing in custody since 26.8.2023 in a case registered for the offence punishable under sections 467, 468, 471, 406, 420 of the Indian Penal Code and Section 66D of the I.T. Act.

3. It is a case of cheating. Allegation against the petitioner is of committing fraud and taking Rs. 14 lac from the informant in lieu of giving him employment.

4. Learned counsel for the petitioner submits that the petitioner is ready to pay Rs. 5,35,000/- (five lakh thirty five thousand) to the informant. A supplementary affidavit to that effect has been filed.

5. Learned counsel appearing on behalf of the informant does not controvert the submission of the learned counsel for the petitioner.

6. In that view of the matter, it is directed that at the time of filing the bail bond, the petitioner shall pay Rs. 1,35,000/- to the informant and the rest amount of Rs. 4,00,000/- shall be paid into two equal installments within three months from the date of filing of the bail bonds.

7. Considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Cyber P.S. Case No. 73 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Patna.

8. The aforesaid payment will be subject to the final adjudication of the case.
