2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 307, 326, 120 ( B ) and 34 of the Indian Penal Code and 27 of Arms Act. 3 . As per the prosecution case , on the alleged date and time of occurrence , this petitioner along with other coaccused persons riding on the motorcycle intercepted informant and made indiscriminate firing upon her due to which informant received firearm injury on thumb of left hand.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged.
Patna High Court CR. MISC. No.83924 of 2024(3) dt.27-01-2025 2/2 Allegation is general and omnibus. It is not specific that who caused firearm injury to the informant. Doctor has found the injury simple in nature . Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today , let the petitioner, as named above , be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class Madhepura in connection with Muliganj P.S. case No. 319 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
