2. In this case, the petitioner is seeking regular bail in connection with Delha P.S. Case No. 47 of 2024, registered for the offences punishable under Sections 341, 323, 326, 307, 504, 506, 120(B) of the IPC and Section 27 of the Arms Act.

3. As per allegation, the petitioner along with other co-accused persons is said to have fired upon the injured person. The injured person suffered fire arm injury on his back which is alleged to have been fired by the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case due to previous enmity. Nothing was recovered from his conscious possession. His name transpired only due to his

Patna High Court CR. MISC. No.86083 of 2024(2) dt.14-02-2025 2/2 past criminal history. Co-accused Mohan Manjhi has been granted regular bail by this Court vide order dated 02.08.2024 passed in Cr. Misc. No. 52736 of 2024. The petitioner is under custody since 07.03.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Gaya in connection with Delha P.S. Case No. 47 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

7. Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any case other than the cases described in para 3 of the bail application, his bail bond shall not be accepted.
