The petitioner seeks bail in a case registered for the offence punishable under Section 395 of the I.P.C. The F.I.R. of the occurrence of dacoity is against unknown. Petitioner is in custody since 08.07.2019. Learned counsel for the petitioner submits that the petitioner was never put on T.I. Parade during investigation of the case nor any incriminating article was recovered from possession of the petitioner. Learned counsel for the petitioner further submits that the chargesheet has been submitted. The petitioner is not named accused of the F.I.R. and the name of the petitioner has been surfaced on the basis of the confessional statement of the co-accused namely, Sandeep Kumar

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. Case No. 29 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
