====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 09-02-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Warisnagar P.S. Case No. 64 of 2021, lodged on 16.03.2021 under Sections 302, 201, 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the bail application of the petitioner was rejected vide order dated 14.11.2022 passed in Cr. Misc. No. 24038 of 2022. Counsel also submits that a report has been called for vide order no.2 dated 22.12.2023 and it transpires from the said report that the trial court has anticipated that within four months, the trial shall be

4. Learned counsel for the petitioner submits that the petitioner is in custody since 21.08.2021.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that as per the report, out of nine witnesses, only one witness is yet to be examined.

6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Warisnagar P.S. Case No. 64 of 2021, pending before the learned Sessions Judge, Samastipur is hereby rejected.
