1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned A.P.P. at the outset submits that the modification application is misconceived for the reason that if petitioner is aggrieved by the fact that the order was obtained based on misrepresentation then in that event he has remedy of filing a proper application before an appropriate forum in accordance with law.

3. Permission is accorded.

4. Learned counsel for the petitioner is not in a position to rebut the submission of the learned A.P.P. for the State.
