The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 307, 353, 504 of the Indian Penal Code and 37(kha)(ga) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case, in short, is that on the eve of Dushara Puja, the accused persons in drunken state assaulted the police personnel and created obstruction.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.10.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. There is no recovery of liquor in this case. The petitioner is alleged to have misbehaved

Patna High Court CR. MISC. No.72401 of 2019(2) dt.15-11-2019 2/2 in drunken state. It is further submitted that no injury was caused to any one.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Special Judge, Excise, Patna in connection with Special Case No. 8939 of 2019 arising out of Paliganj P.S. Case No. 373/2019.
