JUSTICE BIRENDRA KUMAR ORAL ORDER 05-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406,420,467,468 of the Indian Penal Code.

Allegation is that one Kiran Kumari was appointed as Panchayat Teacher on the basis of a forged and fake credential. The petitioner was Mukhiya and a Member of the Selection Committee. Kiran Kumari has already been allowed anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. No. 46196 of 2018. Submission is that genuineness of verification of the certificate was done subsequently and it was found fake. Hence, it cannot be said that there was some motive for appointing Kiran Kumari on the basis of fake

Learned counsel for the informant opposed the prayer for anticipatory bail on the ground of criminal antecedent of the petitioner.

Perused the single case against the petitioner disclosed in paragraph-3 of the bail petition. Considering the entire facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Karpi (Sahar Telpa) P.S.Case No.193 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
