JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bairiya P.S. Case No. 207 of 2018 registered for the offences punishable under Sections 363, 366-A of the Indian Penal Code and Section 8 of POCSO Act.

The statement of victim has been recorded under Section 164 of the Cr.P.C. in which she specifically stated that it was petitioner who forcibly took her and made captive to her in a house.

Although, learned counsel appearing for the petitioner submits that the victim was recovered from the house of Raja Mian and as a matter of fact, the victim was in love with

Patna High Court Cr.Misc. No.59822 of 2018(3) dt.14-12-2018 2/2 aforesaid Raja Mian and that is why to save the aforesaid Raja Mian, she implicated the petitioner but I am not, at all, convinced with the aforesaid submission.

Accordingly, this anticipatory bail petition stands rejected.
