28-09-2018 Heard Sri Sunil Kumar, learned counsel for the petitioner and Sri Shyam Kumar Singh, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Vaishali Complaint Case No. 1583 of 2003 for offence under Section 392 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner submits that the petitioner has falsely been made accused by father-in-law of younger brother of the petitioner, as if, the petitioner is accused for commission of offence of robbery.
Besides hearing, I have perused the complaint petition
Patna High Court Cr.Misc. No.60141 of 2018(2) dt.28-09-2018 2/2 and I am of the opinion that it is a fit case for extending the privilege of anticipatory bail.
Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Prem Kumar @ Prem Kumar Shah be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Complaint Case No. 1583 of 2003, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
