2. The petitioners seek regular bail in connection with Laheri P.S. Case No. 616 of 2023 registered for the offence under Sections 420, 406, 34 of the Indian Penal Code.

3. It is a case of cheating. The FIR named accused persons including the petitioners took Rs. 12 lakhs from the informant and said that they made his amount triple in two months. After some time, when the informant asked for his money, the accused persons did not give the same and started making excuses.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. The petitioners are not named in the FIR. Their name came into light on the disclosed of co-accused persons. No any specific allegation attributed against the petitioners for cheating or taking money from the informant. The petitioners have got no criminal antecedents. It is further submitted that the petitioners are languishing in judicial custody since 4.10.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period , this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Laheri P.S. Case No. 616 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif.
