Petitioner, apprehends his arrest in connection with Darauli P.S. Case No. 62 of 2019 registered for the offences punishable under Sections 341, 323, 324, 307, 506, 427, 34 of the Indian Penal Code.

Informant in his written complaint has stated that on 18.04.2019 at about 7:00 P.M., Chhote Lal Chauhan, Bishwakarma Chauhan and Panchkarma Chauhan (petitioner) came and stopped the measurement of land. Further allegation against petitioner is of inflicting knife blow on his left arm and when his younger brother Shiv Kundal came to pacify the matter, he was also assaulted by Panchkarma Chauhan (petitioner) and all his family members.

Patna High Court CR. MISC. No.73926 of 2019(2) dt.25-11-2019 2/2 It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner has no criminal antecedent.

In the facts and circumstances as stated above, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected.

However, if petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered preferably on the same day on its own merits without being prejudiced by the order of this Court.
